The Aeronautical Arbitration Court of Moldova, in order to maintain the highest level of quality of its activity and align with national and international rigors in the field of personal data protection, has implemented the GDPR (General Data Protection Regulation) system, according to the Directive of the European Parliament and Council no. 679/2016 of 27 April 2016 “on the protection of individuals with regard to the processing of personal data and on the free movement of such data”.

Memorandum of Cooperation signed
Today, the Public Property Agency and the Arbitration Association of the Republic of Moldova signed a Memorandum of Cooperation.
According to the current legislation of the Republic of Moldova, the state is obliged to inform the society about the existence and benefits of any kind of methods to resolution of disputes, such as, for example, arbitration. Unfortunately, until recently, this idea did not find a clear response from the side of state authorities.
However, this year the situation has gained a favorable turn. The Arbitration Association of the Republic of Moldova and the Public Property Agency signed a Memorandum of cooperation, which, according to experts in the field of law, demonstrates the intentions and desire of state bodies to expand the possibilities of providing information for the business environment on alternative options for resolving disputes.
The signed memorandum is based on the support of democratic values and the principles of the supremacy of law, the development of justice policies through arbitration institutions in the Republic of Moldova, and the development of reference strategies in this area at the national level in cooperation with government bodies and international structures.
Within the framework of the signed memorandum, the Public Property Agency of the Republic of Moldova, represented by the General Director Mikhail RUSU and the Association of Arbitration of the Republic of Moldova, represented by the President of the Association, Valentin VIZANT, will collaborate in organizing, conducting and participating in seminars, conferences, meetings, trainings on both international and national level, attracting qualified specialists in the priority areas of the Association of Arbitration, namely, arbitrators, experts, local and foreign experts in the field of arbitration justice.
According to the Chairman of the Association of Arbitration of the Republic of Moldova Valentin VIZANT, this agreement will help not only to participate in various national and international programs and projects, but also to actively cooperate in preventing acts of corruption and other negative manifestations.
“This agreement will give impetus to the development of arbitration and arbitration bodies in the Republic of Moldova as a whole. This is a very positive signal for our justice. I would like to note that those who once resorted to the services of an arbitration court are imbued with great confidence in this structure. That is why more and more legal entities that understand the benefits of arbitration always enter an arbitration clause in contracts signed with clients, ”said VIZANT. The arbitration court is designed to increase the use of national and international arbitration, as well as other alternative methods of dispute resolution, including mediation.
The Republic of Moldova is among the 150 states that have signed and ratified the UN Convention on the Recognition and Enforcement of Foreign Arbitral Awards.


Seminar “Introduction to arbitration”
Today, at the Palace of Culture of Railway Workers, Chisinau, the Arbitration Association of the Republic of Moldova, represented by its Chairman Mr. V. VIZANT, Chairman of the Economic Arbitration Court Mr. A. VOLGHIN, and the Chairman of the Arbitration Court of Chisinau Mr. A.ȚELIHOV, held an information seminar on the topic: “Introduction to Arbitration” for Legal Departments` employees of state enterprises and enterprises with a state share in the authorized capital.
During the seminar, arbitration experts shed light on certain aspects of the arbitration proceedings, on the main directions of the development of arbitration as a part of the general task of state reforms in the field of justice, including as a highly effective tool to overcome the problems existing in Moldova in this sector, and as an already tested way to fight corruption.
The seminar ended with numerous specific questions of the participants and the search for ways to solve them with the assistance of arbitration. The activity in this direction continues.

New Rules of the Aeronautical Arbitration Court of Moldova have been approved
By decision of the Administrative Council of the Arbitration Association of the Republic of Moldova No. 4/2018 of 21.06.2018, the Rules on Arbitration Proceedings and the Rules on Arbitration Fees and Expenses of the Aeronautical Arbitration Court of Moldova have been approved and officially registered on 02 July 2018 at the Supreme Court of the Republic of Moldova.

New order of the execution of some acts
We draw your attention, that in connection with the entry into force of a new wording of the Art. 178 (2) of the Civil Proceedings Code of the Republic of Moldova, since 01.06.2018 the decisions on the application of interim measures made by the courts constitute by itself an enforcement document, which is subject to immediate execution without the need for enforcement order to be issued.
Also, according to item k-1 Art. 11 of the Executive Code of the Republic of Moldova, a similar procedure has now been established for arbitral awards on approval of a settlement agreement.

Taking part in the Second Congress of the Kazakhstan Union of Lawyers
The Economic Arbitration Court of Republic of Moldova took part in the Second Congress of the Kazakhstan Union of Lawyers, held October 20, 2017 in the Republic of Kazakhstan, Astana.
The congress brought together deputies of the Parliament of the Republic of Kazakhstan, official representatives of the prosecutor’s offices, state courts, the Bar Association of the Republic of Kazakhstan, international arbitration institutions and public organizations.
The honor to speak at the Congress on the part of foreign guests was given to the vice-president of the Union of Lawyers of our country, the arbitration judge of the Economic Arbitration Court of the Republic of Moldova, the Honorable Consul of the Republic of Moldova in the Republic of Kazakhstan, Mr. Valentin VIZANT.
In his speech, Mr. VIZANT emphasized the importance of strengthening interstate multilateral relations and further development of cooperation in the field of jurisprudence, expansion of business ties between east and west, including through the use of international commercial arbitration mechanisms that are traditional for world practice, the need for effective support from state institutions in resolving the problems that arise in the administration of justice by international arbitration.
Other participants of the Congress also spoke on the most topical issues of advocacy and arbitration activities, sharing their own experience in resolving them, jointly discussing options for their resolution. Preliminary agreements on the creation of a new international commercial arbitration in the Republic of Kazakhstan have been reached.

On October 10, 2017, representatives of the Arbitration Association of the Republic of Moldova and the Economic Arbitration Court of the Republic of Moldova took an active part in the Chisinau International Business Forum held in the Republic of Moldova, mun. Chisinau as a part of the First International Industrial Exhibition “EXPO-RUSSIA MOLDOVA 2017”.
The participants of the forum were greeted in particular by: the President of the Republic of Moldova, Chairman of the Committee on International Affairs and Minister of Foreign Affairs of the Russian Federation. The working program of the forum was also attended by the Russian Ambassador to Moldova, the Bashkan of Gagauzia, representatives of the state authorities and Chambers of Commerce and Industry of both countries, Russian and Moldovan companies in the fields of energy, industry, agriculture, medicine, health, education, engineering, aviation etc.
The forum participants exchanged views on the need to continue expanding mutual relations, the importance of improving their regulatory settlement, including through the use of special clauses in the contracts that would ensure mutual respect for the rights of the parties, including through the use of mechanisms of international law, in order to effectively resolve problem situations, that it is arbitration justice that allows to do this most successfully.
